Can I copy someone elses web API?

I want to implement an identical web API (Application Programming Interface) to one that a website has already published. Can I:

1) Use it exactly as it is?
2) Use it as long as I change the methods called?
3) Not use it at all? It's copyrighted?!

If unsure, can anyone recommend someone to ask - whether its an individual, website, or a lawfirm that might deal with this.
