Hi,

I have found out that a business in Australia is using one of our photographs on their website.

I have asked on several occasions for them to remove the image but they have refused.

There is not a dispute that the photograph is ours.

We are based in the UK and wanted to try and get some advice as to the best way to deal with this and have this company remove the image.

First thing to do is send a cease and desist letter to them and also get in contact with the ISP hosting the site and report the infringement to them. They may save you a lot of hassle by taking the site down - or at least removing the stolen content if the site owners do not.
