RECENTLY I HAD A BUISNESS IDEAR WHICH USES A SPORTING AID BUT IS REDESIGNED AS A FASHION ITEM. THERE ARE VARIOUS PRODUCTS BUT ONE IS VERY SIMILAR TO THE SPORTING AID ITSELF EVEN THOUGH THE USEAGE IS COMPLETLEY DIFFERENT

WILL I BE INFRINGING ON COPYRIGHT OF THE ORIGINAL PRODUCT AS THE SIMILARITY IS STILL THERE AND I AM WORRIED THAT BASED OFF AN EXISTING PRODUCT THIS WILL LEAVE ME LIABLE
2.
HOW WOULD I GO ABOUT FINDING THE INFOMATION TO GET PERMISSION IF REQUIRED

OR IS IT, AS I HAVE BEEN TOLD THAT BECAUSE I HAVE CREATED A PRODUCT THAT IS IN ANOTHER ARENA I SHOULD GET A PATENT TO PROTECT MY NEW INNOVATION.

I think the information you have been told is correct. If this is a product, then it is more likely to be a patent or design right rather than copyright.
Copyright would apply to original artwork your created, or literary work to support the product (promotional literature, website, etc.), but not the product itself.
I would be cautious to avoid this appearing to be an copy or adaptation of the existing product you mention, but otherwise provided you are not infringing a patent, I suspect you will be OK. Having said that, I am not an expect in product design/patent matters. You best bet is probably to speak to the Patent office ( http://www.ipo.gov.uk/patent.htm ).
