Re: Pixsy.com email re use of photo on website demanding fee
"As far as I know it is not possible to check an image to see if it is copyrighted. If there is no watermark or copyright mentioned then I do not see how anyone could be guilty. But I know the law doesn't work that way. I try to be very lawful in everything I do. It seems we are getting caught in a ...

Re: Copying Kanji using Handwriting
Japanese typefaces or font sets are a special case. I don't know all the details but apparently the copyrights belong to the Japanese Government and they charge a very high fee for their use. The guy who fixes my Macs also fixes for a Japanese typesetter locally. He told me that each set costs her ...

I did several Penguin covers in that period. Penguin most certainly own the copyright unless it was an existing image sold as stock.

Re: Designer copyright law - reselling items
Are you sure it is copyright that is the issue here. From memory I think it is Trade Mark law that they will be using. Their argument is that the copies used inferior materials which should not be associated with their brand name. (I was told this while NOT sitting on an original. The owner wouldn't ...

Re: Using books for an art installation
There is no copyright in the titles of books or the authors' names, so creating your own dust jackets would not infringe any copyright.
I have just remembered that some authors are now trademarking their titles or sub-titles. Would that not cause a small problem?

Re: Ownership of goods created
As infringing articles you can ask for them to be destroyed but I'm not sure about owning them to sell at a profit.
I had an infringement many years ago of printed material and went through the problem of having the infringing copies removed from the market. I also asked for the printing film to be ...

Re: Using books for an art installation
If you are mounting them on a wall they will not be read so I would have thought that you do not need to ask permission of the author. However the covers would be a different matter and I would ask permission of the publishers to use the cover artwork in this way. I cannot see any reason for them to ...

Dear Andy
We have a problem in that not all IPEC cases are published and many infringers settle after papers are sealed and delivered so never come to court.
Photographers are generally friendly people and network effectively to help each other. I am not 100% certain of the way Pixsy works but ...

Re: Pixsy Email Help
I disagree. There is nothing which says that a German photographer cannot bring a case to IPEC without using a lawyer. As we have seen from the recent case shown on this forum the court can be very generous in awarding costs to pay for a photographer's travel and accomodation expenses. The infringer ...
