I recently came across this claim as a website 'disclaimer'. There is no doubt the original material is out of copyright but other than transcribing - and this could have done ...

Re: Tracing photographers
Thank you Andy.
The photographs are prints, I suspect unpublished in newspapers, which would be the main publication outlet.
It appears to be a classic case of Catch 22. Would I be right in thinking that if I showed the original print to someone in person then no breach would have occurred as I am ...

Tracing photographers
Unidentified photos/photographers, reasonable to suggest they are still in copyright.
An Internet group of experts could probably identify them but only by uploading to the site, therefore breaching copyright.
Is there a way of doing this legally and once identified making further enquiries to ...

Re: PicRights and The Tax Man
I don't think you can infer anything relevant to your concerns from their accounts.
The company, because of its size, only has to supply limited information to both Companies House and HMRC. A member of the public is entitled to see the former via their website but not the latter. HMRC could ask ...

Snapperman67. Have you read the verdict of the Webb aviation case but it basically says the opposite of what you are saying? The court states that the normal pricing is the license fee usually charged. (The rest of costs are for flagarancy, which is a seperate matter to most of these type of cases ...

For US infringers, I would suggest looking at this judgement for an actual claim for one image pursed by Pixsy https://www.emphasisphotography.co.uk/
How do we know this was a Pixsy pursued case?
It appears to an undefended claim led by the Photographer direct, as indicated by the court costs ...

Public Doman newspapers
I am a frequent user of the British Newspaper Archive.
They have noted some newspapers as being in the Public Domain and I believe you can view these on the site without payment*. However, other newspapers of the same date are shown as being in copyright "Image © THE BRITISH LIBRARY BOARD. ALL ...

A now defunct sporting club produced a dinner menu in 1905 (under their own name). There is no way of deciding who produced it and it all likelihood it would have been a collaborative effort. It was 'published' at the actual meal in the same year.

I've just been reading the Morel case and in my mind it re-enforces the idea that certain Photo Libraries will seek to claim ownership when none is due and use their weight to press others into agreeing with them.
I've struggled to find a case (through internet searches) which show that Getty's for ...

Web forums/Hyperlinks/Quotations
The query involves a UK web forum. Posters are allowed to post hyperlinks to other sites/stories but are they allowed to post a small (say less than 100 words) quotation from the webpage to which they have hyperlinked?
They would do this to clarify the part of the story to which they refer and are ...

Re: Sports Results (IP law)
Hi,
I'm after some advice on sports results and intellectual property. I have for the last few years been recording the results & lineups of my favourite sports team. This was originally done just for my personal benefit. About 2 years ago I published the data on my website. Since then I've been ...
