The typographical layout protection provided by the Copyright Designs and Patents Act would not apply since the only element from the original card to be re-used (not copied) would be the image (even if that image incorporated some words).

If you are re-using the original article then there is simply no copying involved, therefore the question of copyright ...

Own-It has just published a fact sheet on this issue: Re-using design. In particular the section on up-cycling seems most relevant - but I'm not sure it's any more illuminating than the discussion above.

I would not be mass commercializing their products but I only want to make a single item and only to customer bespoke requests.

I don't think it really matters how many you make, one is enough to invite litigation.

I was contemplating selling some at craft sales or on ebay.

That's essentially what we would term "commercial", making and selling the cards becomes a commercial enterprise. You'll be showing images of the cards/publicising your work, so that anyone interested in the rights of the original card ...

I was thinking of cutting out the nice pictures and / or just the text "Happy birthday" from the front, re-mounting that in a variety of ways on a new card,

A sort of new topper made from a picture on a used card !!!

I wont be photocoping it will be the original ...

Faithful reproduction on a scale model isn't an infringement in itself, but if the main car company market its own scale models under that trademark and the existence of the 3rd party scale model company's products affect the sales of the car company's own scale models, then it's an infringement ...

I just had my boss on the phone, saying he's been talking to a motorsports photographer / artist who takes photographs of cars and bikes at motorsports events such as Formula 1 Grand Prix races, and then makes paintings out of them which he sells online.

This is a trade mark or passing off issue ...

People at work are really starting to hate me. :lol: I need to find an avenue of attack that increases our portfolio instead of reducing it soon or I'll get lynched by our designers.

Original ideas, that don't trade on someone else's designs/goodwill?
