So here's the next development.

I wrote to them saying:
Upon receiving your email, we removed the image in question from our website while we investigated where it had come from as we take such things very seriously.

I now have confirmation from the owners of the subject in the photo ...

Hi Andy,

Thanks for the swift response. Looks like Tineye's date is not a reliable indication of upload date sadly, so I have no case on that front.

I did manage to get hold of the case study subject company and they said they had been given permission to use the photo by the photographer ...
