On another point, ianal but that analysis regarding the mod chip by the judge seems to me to be plain wrong :shock:

Recordings of illegitimate origin

I have some questions which are kind of related to the other thread on video recordings, but a bit more general. Also there is a court case current in Scotland on bootlegging (selling the illegitimate recordings), which covers copyrights and trademarks, which touches on some aspects.

Any my questions. For the UK:

(a) does copyright infringement fall under criminal, civil or common law?
(b) was it different prior to the 1988 Act?
(c) or does/did it all depend upon the nature of the infringement/offence?
